Buying, selling, dissolution of condominium or donations

Our services will help you to:

  • Complete advice, conveyance and legal representation (optional) during the whole process with assistance in three languages (Spanish, English and German).
  • Obtain a tax number (NIE for citizens) or NIF (foreign companies) for non-resident people, necessary to present tax declarations in Spain. 
  • Supervise and/or to prepare the previous purchase and sale contract between the buyer and the seller (before signing at the notary). This way, all parties have a clear and explicit agreement of the rights and obligations.
  • Have a preliminary estimation of all costs involved; this way, you will avoid paying more than the necessary costs in the operation and to consider any other potential expenses that may arise: taxes, notary fees, land registry fees or others. It includes the estimation of the potential capital gain or loss to declare after completion or to apply for any tax refund (case of non-resident sellers), as it corresponds.
  • Expert tax advice to apply deductions and to avoid paying more than you should do (i.e. to get the refund of the 3% retention on the selling price the buyer must retain to non-resident sellers by law or to pay the capital gain tax in case the non-resident seller obtains a profit in the sale, or to update the tax situation of the client).
  • Assistance to obtain any necessary paperwork for completion: certifications and licenses from town halls and community of owners; energy efficiency certificate; extension and end of work title deeds, mortgage cancellations.
  • Assistance to arrange the payment of any possible outstanding debts before completion.
  • Get a quick response for any consultancy and answer to questions during the purchase/sale process.
  • Verify and control the paperwork, as well as the tax and legal situation of the property before the completion at the notary. This way, we will be able to help to pay any outstanding debts, expenses or taxes of the seller before the completion so that to obtain the security of buying/selling a property without any charge or encumbrace.
  • Legal advice and management with banks in Spain: opening of a bank account, financial advice and management of funds, application of loans and mortgages, paperwork assistance before and after completion.
  • Personal conveyance with the client at the notary, with revision and check of the title deed preior to sign it.
  • Verify and control the after purchase or sale managements, an essential step to guarantee: the registration of the property in name of the new owner/s; to fulfil with the legal and tax obligations that both the seller and the buyer have before the Tax Office; to confirm that the cancellation of the mortgage has been correctly registered and paid; to pay the legal taxes correctly by filling the corresponding forms, to avoid paying taxes you could get exempted; to change the name of the new owner/s in domestic services, council tax or community of owners; to get home insurance quotes.
  • Final liquidation with detail and proof of all payemnts done on behalf of the client.
  • Assistance with certified translations and foreign paperwork legalizations.
  • Possibility of representation by means of a power of attorney, which would avoid you to come to Spain to sign the completion as well as paperwork before or after the transaction.
